Bullshit and fucking Jellybeans!

Thanks for your further emails.
We’ve got your claim file ready but due to its size we’ve discovered that we can’t post it to a PO Box.  Bearing in mind you don’t want to pick it up at a Branch, perhaps we can courier it to a person of your choice (GP, JP, friend or relative)? We’d much prefer this to ensure your information remains private.
You also asked for a copy of the report into whether Dr Jansen accessed your claim file.  Your request was made under the Official Information Act and so a formal response is required by law, and that response is attached to this email.
I’m sorry to say that we’ve had to turn down your request and I know that will be disappointing but there is a good reason.  Because it was prepared for internal ACC use, the report contains a lot of information about how we carried out the investigation and we need to keep that confidential.  If we let that information out it could prejudice our ability to carry out future investigations. 
But we can provide you with the Report’s conclusion, which states that:
“Based on the system access records investigated, we can confirm that the particular staff member has not accessed the claimant’s personal information through ACC system applications.
We can also confirm that the particular staff member did not access the specific claim physical file in the Sensitive Claims Unit …”

While I know you wanted the full report, I’m hoping its conclusion is a first step towards you regaining faith in ACC’s management of your personal information.

  1. Um email them back & ask for an "independent" review into there internal systems, not there person who is not going to admit any privacy breaches or make any damning recommendations!

    Reading between the lines, they know its been breached but wont admit it, so id forward that response to your lawyer & the Labour party MP who raised it in the house.

    Why the change now??

    Why do they need to keep the investigation confidential? WHAT DID THEY ACTUALLY FIND OUT?
    It's not like you need the printout of the claimants files who he did assess, just the terms of reference and the process taken. We already know they didn't check his email and that the wanker is lying AGAIN cos you emailed him and he knows you were a claimant.

    She still hasn't stated how he did find your details. You think she's covering up cos she knows he did something he shouldn't have to get your details?

    Hi Denise

    Further to my email a week ago, when I asked for you to email me to let me know whether my file had been sent, I have not received a reply. I was under the impression that this would take a few days and yet a week later, you are still yet to confirm having even sent it.

    I understand, from your previous email that you were concerned about that lack of service I received at ACC and I did regard your initial reply as an attempt to rectify those admitted concerns.

    I would like to add, therefore, that this is yet another unacceptable delay in basic communication.

    I would like my file sent to me. When will that be done?
    I want acknowledgment of my previous email.
    I want a copy of the report handed to Dr Peter Jansen on May 6th (12 days ago) that stated there was an investigation into who had access to my files.
    I want an explanation into the delay of that report (number 3)

    Stop stalling. My file is so "sized" that what? It won't fit in a post office secure box? How the hell can that be? I haven't had a response to my claim in over two years... so how does that add up? .... (ho hum).....ONCE again I REQUEST you SEND MY FILE as PREVIOUSLY REQUESTED! NOW! This is not and never will be about WHAT YOU PREFER. I have officially requested my file, as per my LEGAL RIGHTS. I have instructed you on how to deliver it. I simply ask - you DO IT!

    I want it duly noted that you are REFUSING to send information ON ME that I am LEGALLY ENTITLED TO...

    As far as the report into whether Jansen accessed my file - to which he made a PUBLIC STATEMENT INTO HAVING RECEIVED.... This is bullshit! It's PUBLIC INFORMATION... Jansen sued me as a private citizen. He forfeited the right to access my files as anyone under ACC yet he got the report.

    Give me a copy NOW.

  7. Jansen doesn't do this work. He is NOT an IT specialist. ACC pay staff to monitor blogs/websites then do investigative work to find out who then person is blogging etc. This info was passed onto Jansen, others in ACC who commissioned the lawyer to file claim against you. What you need to find out is who specifically accessed your file, (each and every person), for what purpose (acc legislative or Jansens private purpose/private breach), what they accessed and when, who specifically passed this info about YOU onto Jansen or 3rd party lawyer/representative, and for what purpose? Who gave authority for information to be released. Where is the consent?

  8. Jansen says he's read eos reports and then makes decision to cut claimants off claim, altering claimants lives forever. Then next report from Jansen is totally contradictory and says he hasn't read all reports on EOS.

    I'd suggest Jansen is a liar, irresponsible and a poor clinical doing the devils work for ACC. He hasn't got to time to read medical reports yet he signs all these opinions affecting peoples lives, treatment, without having read their medical reports.

    Every claimant should ask ACC for their access file to their EOS records where Dr Jansen has made decisions and I suspect you will find he has NOT read your file like he states he has before issuing a decision. This is the job of the underlings - the low life Branch medical Advisors instructed to remove claimants or claim liability.

    Jansens just signs forms.

    Odd that a file can be so big that it can't be delivered to a PO Box... Have you seen some of the boxes that are in the back of courier vans? I've been in the post office when people have had large boxes handed to them because they didn't fit in their PO Boxes. Sounds like a stone wall.

    As for the investigation report... hmmm to sound a bit conspiracy theorist... if the reports are so detailed, then surely Jansen has seen them in the past, so knows how to skirt around them. But in reality, how much more detailed can it be than the sort of thing you see the groups such as the electronic/data forensic investigators being interviewed about for newspaper articles??? Sounds like a another stone wall.

    Your response, for a better word, is inadequate, inappropriate and incorrect.

    I want to know how Dr Peter Jansen, as a PRIVATE CITIZEN had PUBLIC access to report, as reported in the NEWS, to my files - ACC FILES, might I add....to which, I was their client, YET info given to HIM nonetheless... so, why the hell can't I get a copy!????


    Where is YOUR so called investigation into this matter, as claimed by the HOUSE? How dare you give HIM access to info about ME and I am not even ALLOWED to know.

    1) I want a copy of Jansen's report (the one he went PUBLIC about) and to which he refers to in the PRESS about accessing my file.
    2) I want what procedure they undertook - NOW

  13. The investigation summary says Dr Jansen did not access the file, but that doesn't mean to say a "colleague" didn't.

    Agree with others re the PO Box - the agent puts a card in the PO Box to say to collect from there store room, same for signature required items. ACC's courier company doesn't courier to PO Boxes but I am sure they can use another if necessary.

  14. In Outlook you can recall emails. Usually a succesful recall can be done if its sent to an internal recipient in their organisation, what ACC doesnt realise is you cannot recall emails to outside recipients.

    With regards to ACC refusing to release the report I would immediately lodge a complaint with the ombudsman. It is relevant to you and you want assurances that nothing was discovered during the investigation, especially as its such a huge issue and ACC is the only organisation that could have such details. The Ombudsman will then investigate the matter and you may find that they may force ACC into releasing the document.

    Sounds to me like some of the ACC staff are helping here to point you in the right direction Jax. Take there advise! You deserve the answers you are seeking.

    Clearly ACC has a computer system that can run an access report to identify whom accessed your electronic file and when. I suggest you request that under Privacy Act 1993.

    Also lodge a complaint to the Privacy Commissioner for release of report.

    Simultaneously lodge a complaint with Ombudsman.

    Also it is total crap ACC can't courier to PO boxes. However I can appreciate ACC want to ensure younget it.

    There are some other things you should request from ACC which is an electronic IT sweep against everything in your name or relating to your file number. These should produce horrendous amounts of information NOT on your EOS file. This will include all internal emails about you/your claim.

    It will also proven very interesting.

    Let me know if you have problems - I have a friend in IT at ACC, so know what reports can be provided:-)

  18. How much actual blog traffic have you been getting from ACC Jax? Most people with blogs find quite a bit from them. They clearly are trolling the blogs so I suspect someone from within ACC came PJ the heads up and got the information he needed to serve you. I still can't believe if they are all so innocent then why not just say where PJ got your details from. FFS it's not asking much!

    now here is the beginning of the real conversation . . . notice how the tone is much less saccharine and believe me it can become much more terse - this tone is mild compared with how it can become. Also I wouldn't worry too much about the budget as a distraction . . . it'll blow over. . . Meantime who are the journo's who picked up the ACC scu stuff in the past? Catherine Hutton on RNZ, Tim Hume at the SST and there are others . . .

  20. Ask for an IT sweep of your file. This will provide all the internal and external emails etc that even mentions your name. Then ask for a full copy of ALL the staff members who have accessed your personal information and the reasons for the access.
